June 2023 Texas Standard Possession Order

INTRO

Happy summer, everyone. It is June, and we are going to talk about the Texas Standard Possession order today. Let’s see what the month brings us. We are looking at the month of June 2023. In the video, the custodial parent is in blue, non-custodial parent is in yellow.

THURSDAYS

As you can see, I have not included any Thursdays this month because I am going to assume that all kids are out for their summer holidays by June. That may not be the case for all of you, but if your child was released for the summer vacation in May there will be no Thursdays in June because we know that Thursdays are only during the school term. If your child is not released until June, say June 2nd for instance, then that Thursday would count non-custodial parent, and you would get Thursday, June the 1st because the kids are still in session in school on that Thursday.

WEEKENDS

For the weekends, we have a 1st, 3rd, and 5th Friday of the month in June. So, the non-custodial parent would get the 2nd, the 16th, and the 30th of June for your weekend visits. Now, on that 5th Friday, the 30th of June, I guess technically your weekend would sort of expire on July 1st at 6, because that would begin your extended summer possession, assuming you took the default dates of July 1st to July 31st. And we know that holidays overwrite the weekend periods of possession, but you would still get your Friday.

HOLIDAYS

Finally, we look at the holidays in June. We have Father’s Day, which falls on the 3rd Friday weekend. Dad, if you are the non-custodial parent, then there’s nothing really to do there. You will just exercise your normal possession. Dad, if you are the custodial parent, then you need to review your order for Father’s Day pickup and drop-off on Father’s Day. So review your order as to the times for your pickup and drop off if you are the custodial parent and you are the father.

For Juneteenth, I don’t recall if Juneteenth is a federal holiday. If it is, then you’re going to have another interesting scenario where non-custodial parent, your weekend is going to be extended until Monday, return time of whatever you would typically return on Sunday because it’s a federal holiday and that falls under the weekend extended by a holiday provision. And it gets really interesting if father, you are the custodial parent because you are going to get your Father’s Day on Sunday, you’re going to return the child to the non-custodial parent who will then have the child until Monday, and then you all would transfer on Monday instead of Sunday. So that is a tad bit confusing.

Okay, so June is a little bit interesting, right? We have a 1st, 3rd, and 5th Friday this month, which is interesting. The 5th Friday rolls you into your extended summer possession, non-custodial parent. And then of course we have Father’s Day followed by Juneteenth, which creates an interesting scenario. If the father is the custodial or the non-custodial parent, you’ll probably go back and listen to that again a few times. Probably even confused myself a little bit on that one.
