Hi, Chris Schmiedeke of Divorced Simplified. So the kids are back in school, and it’s almost September, so where are we in the Standard Possession Order for Texas? So this is a pretty standard month in that we are not going to have a fifth weekend of the month. So you are going to, if you are the visiting parent or the noncustodial parent, you are going to have a Friday the 4th and Friday the 18th will be your weekends for possession. Along those lines, I still get questions from people that get confused about the weekend possessions thinking they get the first, third, and fifth weekends of the month. That’s technically… That’s true, but technically it is the first, third, and fifth Friday of the month. So if you’ll open up your calendar and look with me, you will see that the first Friday of this month is the 4th, the third Friday of the month is the 18th. So those will be the weekend visits. Of course, you’re going to get your weekday visits this month.
So if you have Thursdays, you’ll have the 3rd, the 10th, the 17th and the 24th, if you have a standard possession order. We also have Labor Day. So that is the first weekend of the month. So for the noncustodial parent, you are going to get a Friday, let’s say you’re possession order is Friday at 6:00 to Sunday at 6:00, you are going to get Friday at 6:00 till Monday at 6:00. If you’re a return to school the next day, then you are going to be Friday at 6:00, say till return to school Tuesday, when they go back to school. I can already hear the questions. “Well, the kids aren’t in school, they’re in virtual learning.” No, they’re not.
They’re in school. Kids are all in school now, whether it’s virtual or not. So when you return them to school, you are going to return them to Custodial Parent Elementary, or you’re going to return them to Custodial Parent Middle School, or you’re going to return them to Custodial Parent High School. But you are returning them per the schedule as if they were attending a regular school. So just take them back to whatever elementary they’re at, if it’s Custodial Parent Elementary, or if it’s Joe Blow Elementary, that’s where you’re returning them. All right, so we’re going to keep that part straight. Other than that, looking at the calendar, it’s a pretty standard month.
